Terms and Conditions
A — Scope of these terms
These terms govern all contracts of sale between ERTG d.o.o., Dunajska cesta 159, 1000 Ljubljana, Slovenia (below “we” or “BOLLSEN”) and our customers via the online shop at bollsen-hearingprotection.com. A customer’s own terms do not apply unless we have agreed to them in writing.
Who is a customer?
A customer may be any natural or legal person — whether a private individual (consumer) or a business (trader). A consumer is someone buying for purposes wholly or mainly outside their trade, business, craft or profession.
What can be ordered?
Our range includes physical goods (one-off purchase or subscription), gift cards and digital content (single download or subscription). For subscriptions we supply the agreed goods or digital content for the whole contract term at the agreed intervals.
These terms apply to gift cards and digital content as far as relevant, unless expressly stated otherwise below.
B — How a contract is formed with us
The products in our online shop are not a binding offer but an invitation for you to make an offer.
Ordering process: You place goods in the basket, work through the checkout and finally click the order button — with that you make a legally binding offer to purchase. Orders can also be placed by email or through our contact form.
Our acceptance: We accept your offer within five days — by order confirmation sent by email, by delivering the goods, or by requesting payment. The earliest of these is decisive. If we do not respond within that period, your offer is treated as declined and you are no longer bound by it.
Special rule for PayPal: If you choose a payment option via PayPal, we accept your offer at the moment you click the final order button. The payment service provider is PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg. PayPal’s terms of use apply.
Contract text: We store the contract text and send it to you by email once your order is complete. Customers with an account can view their order history there, protected by a password.
Input errors: Before the order is completed you can correct all details using the usual browser and keyboard functions.
Contract language: The contract language is English.
Communication: We communicate primarily by email. Please make sure your email address is correct and that our messages reach you — including through spam filters.
C — Your right to cancel as a consumer
Consumers have a statutory right to cancel a contract made with us without giving a reason. Full cancellation information, with conditions, deadlines and a cancellation form, is set out in our separate document “Cancellation, Returns & 40-Day Money-Back Guarantee”.
The statutory right to cancel applies to consumers. It does not apply to customers who are purchasing in the course of a business.
D — Prices, delivery costs and payment
Prices: All prices shown are final prices including statutory VAT (20 %) — unless the product description states otherwise. Delivery costs are shown separately.
Deliveries outside the UK may incur additional costs that we do not bear: customs duties, import charges, bank fees or currency conversion costs. These fall to the customer.
The available payment methods are shown during the checkout process.
Advance payment: Where bank transfer is agreed, payment is due immediately after the contract is concluded.
Payment service providers:
- PayPal — Handled by PayPal (Europe) S.à r.l. et Cie, S.C.A., Luxembourg. For invoice or instalment purchases via PayPal, BOLLSEN assigns the claim to PayPal or a provider designated by PayPal; a credit check is carried out beforehand. Payment with discharging effect is then made only to PayPal.
- Credit and debit cards via Stripe — Handled by Stripe Payments Europe Ltd., 1 Grand Canal Street Lower, Dublin, Ireland. Due immediately on conclusion of the contract. Stripe reserves the right to carry out a credit check and may decline this payment method on a negative result. Info: stripe.com

- Apple Pay — Handled via Apple Distribution International Ltd., Hollyhill Industrial Estate, Cork, Ireland, in conjunction with Stripe.
E — Delivery and shipping
Delivery area: We deliver within the area shown in our online shop. The delivery address given during checkout is decisive.
Failed delivery: If a delivery fails for reasons attributable to the customer, the customer bears the additional costs incurred — except where the right to cancel has been validly exercised (in which case see the cancellation terms regarding return costs).
Passing of risk:
- Business customers bear the risk from handover to the freight forwarder or carrier.
- Consumers bear the risk only from the point of personal delivery — unless the customer has engaged a carrier themselves without our prompting.
Supply problems: If we cannot deliver goods because our supplier fails to deliver to us (through no fault of ours), we may withdraw from the contract. We will inform you immediately and refund any sums already paid without delay.
Collection in person is not possible for logistical reasons.
Gift cards are provided: by download, by email or by post.
Digital content is provided: by download or by email.
F — Digital content and rights of use
Unless the product description states otherwise, you receive for the digital content supplied a simple, worldwide and unlimited right of use — for private purposes only.
Passing content to third parties, or producing copies for third parties, is not permitted without our express consent.
Where a contract concerns a one-off supply, the right of use takes effect only on full payment. A provisional permission to use granted by us does not transfer the right.
G — Subscriptions: term and cancellation
Subscription contracts run for an indefinite period. You may cancel at any time and without notice period.
The right to extraordinary termination for good cause — for both parties — remains unaffected. Good cause exists where, taking all circumstances into account and weighing the interests of both parties, continuation of the contract cannot reasonably be required.
Cancellation may be made: in writing, by email, or via the cancellation button on our website.
H — Retention of title and your rights if goods are faulty
Retention of title: Goods delivered remain our property until paid for in full.
Your statutory rights: The Consumer Rights Act 2015 applies. Goods must be of satisfactory quality, fit for purpose and as described. If they are not, you have a short-term right to reject them within 30 days of delivery for a full refund; after that you are entitled to a repair or replacement and, if that fails, to a price reduction or a final right to reject. Nothing in these terms affects those rights.
Special provisions for business customers:
- We choose the form of remedy.
- Period for new goods: one year from delivery.
- For second-hand goods: liability for defects is excluded.
- A replacement delivery does not start a new period.
These limitations do not apply in cases of: claims for damages, defects deliberately concealed, goods incorporated into a building which have caused a defect in it, and statutory update obligations for digital products.
Information for consumers: Please report visible transport damage directly to the courier. This report is not a condition of your rights — we ask for it only to help our internal processes.
I — Personalised products
If we manufacture goods to your individual specification, you are responsible for all content (text, images, graphics) that you send us:
- You must hold all necessary rights of use in that content.
- You ensure that no third-party rights are infringed — in particular copyright, trade marks or personality rights.
- You indemnify us against all third-party claims arising from your use of the content — including legal representation and court costs — unless the infringement is not attributable to you.
- In the event of a third-party claim you will inform us immediately and in full.
We may decline an order if the content supplied breaches laws, official decisions or public decency — in particular unconstitutional, racist, discriminatory, abusive or age-inappropriate content.
J — Gift cards
Promotional cards (issued free of charge, time-limited):
Redeemable only in our online shop during the stated promotional period. One card per order. Redemption is possible only before the order is completed — no retrospective crediting. The order value must at least equal the value of the card; any remaining balance lapses. If the order exceeds the card value, the difference must be paid by another payment method. No cash payment, no interest. On cancellation, the card value is not refunded. Individual products may be excluded. Promotional cards are transferable; we perform with discharging effect towards the current holder, unless grossly negligent ignorance of a lack of entitlement is attributable to us.
Gift cards (purchased for payment):
Redeemable only in our online shop. Valid until the end of the third year following the year of purchase; any remaining balance stays available until then. One card per order. Redemption is possible only before the order is completed — no retrospective crediting. Cannot be used to purchase further gift cards. If the value is insufficient, the difference must be paid by other means. No cash payment, no interest. Transferable; we perform with discharging effect towards the redeeming holder, unless grossly negligent ignorance is attributable to us.
